Justice Arindam Lodh of the Tripura High Court said that the petitioner has suffered mental agony because of the University's negligence.
In a recent ruling, Justice Arindam Lodh of the Tripura High Court imposed a fine of Rs 25,000 on Tripura University for wasting the court’s time and causing unnecessary trouble to a petitioner.
The case involved an Assistant Professor of the university who had applied for the post of Professor (Commerce) at the university but was unable to obtain the required Experience Certificate, despite submitting two requests.
According to the petitioner, in pursuance of an advertisement for the post, the petitioner desired to apply for the post of Professor (Commerce).
Some criteria are mentioned in Clause 5 and 19 of the advertisement which stipulates thus: 5. Candidates already in employment shall apply through proper channel (and submit a formal “No Objection Certificate’ during the interview, if called for). 19. Experience Certificate: All claims of experience shall be supported by an Experience Certificate which should be clear and complete in all respects in the organization’s letterhead, bear the date of issue, specific period of work, name and designation of issuing authority along with signature and official seal.”
The last date for submitting application for the post is tomorrow that is November 10, 2024.
The petitioner, seeking to apply through proper channels, was unable to get the certificate from the university in time, forcing him to file a writ petition.
The university initially claimed the certificate was not necessary for internal candidates, citing a misinterpretation of the advertisement. However, Justice Lodh rejected this explanation, criticizing the university for its negligence and the unnecessary delay.
In his judgment, Justice Lodh stated that the university’s failure to issue the certificate caused the petitioner mental distress and compelled him to approach the court.
Justice Loadh in his judgement it was clearly mentioned that ” I am in agreement with Mr. Roy Barman, learned senior counsel appearing for the petitioner that the petitioner has suffered mental agony for not issuing Experience Certificate by the University and further, the petitioner has unnecessarily been compelled to take the burden of filing the instant writ Considering the matter in its entirety, in my opinion, the respondents-Tripura University is found to be enough negligent in dealing with the matter and the explanation, learned Registrar has given to this court, in my opinion, cannot be acceptable.”
The court had directed Tripura University to pay the fine to the petitioner by November 8, 2024 and ensure the Experience Certificate or a notification clarifying the requirement for internal candidates was issued promptly.
The court concluded the matter by ordering the university to facilitate the petitioner’s application for the post as per the original advertisement.
