Assam Government Announces Republic Day Sentence Remission for Prisoners

It will benefit prisoners who have been convicted by courts with original jurisdiction in Assam and are currently lodged in jails.

The Home and Political Department of Government of Assam has announced a remission of sentences for certain categories of prisoners as a goodwill gesture in commemoration of the Republic Day 2025. This decision, made under the powers conferred by Article 161 of the Indian Constitution and Sub-section 1 of Section 473 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been approved by the Governor of Assam.

It will benefit prisoners who have been convicted by courts with original jurisdiction in Assam and are currently lodged in jails within the state or outside, except for those convicted of specific offences mentioned under the law.

According to the order, remission of sentences varies based on the length of the prisoners’ sentences. Prisoners serving rigorous imprisonment of more than one year will receive a remission of 30 days, those with sentences between six months and one year will receive 15 days, those serving between three and six months will be granted 10 days, and prisoners with sentences ranging from one to three months will be eligible for a remission of five days.

However, the remission will not be applicable to prisoners convicted under certain laws and offences. This includes those convicted under the Foreigners Act, the Passport Act, the Narcotic Drugs and Psychotropic Substances Act (NDPS Act), and the Prevention of Corruption Act. Convicts of heinous crimes such as rape, offences against the state, or under Sections 126 and 128 of the Bharatiya Nagarik Suraksha Sanhita, 2023, are also excluded.

Additionally, prisoners sentenced to simple imprisonment in lieu of fines, foreign nationals convicted under any act, and those convicted under the Prevention of Food Adulteration Act, Suppression of Immoral Traffic Act, or Sections 3 to 10 of the Official Secrets Act, 1923, will not be eligible for remission.
