Gauhati HC’s Judgement on APSC Unfortunate and Sad, Will Challenge in SC: Assam CM

The appellants had challenged the earlier judgement passed by a single judge upholding their dismissal from service.
Assam Chief Minister, Himanta Biswa Sarma on Saturday said that Assam Government will challenge the division bench judgement of Gauhati High Court to reinstate 52 officials dismissed in APSC’s cash for jobs scam in the Supreme Court.
Talking to journalists at Salbari in Baksa district, Chief Minister, Sarma said, “We will definitely challenge this judgement in the Supreme Court and we will fight till the last moment to ensure that nobody who got appointment in APSC by unfair means are reinstated.”
Chief Minister, Himanta Biswa Sarma said that though he has not thoroughly gone through the entire judgment, but the judgement is unfortunate and sad and has brought a sense of hopelessness.
Chief Minister, Sarma said, “The division bench judgement on APSC is very sad. This has brought a sense of hopelessness in our minds. At a time when there is an effort in Assam to give appointments purely based on merit, this type of judgement is unfortunate.”
The Gauhati High Court on Friday directed the Assam government to reinstate 52 of the 57 dismissed civil, police and allied service officials of 2013 and 2014 batch who were involved in the cash for jobs scam in the Combined Competitive Examinations (CCE) conducted by Assam Public Service Commission (APSC).
A Division Bench, comprising Justice Kalyan Rai Surana and Justice Malashri Nandi, heard a batch of writ appeals and directed that the dismissed officials, who had completed the probation period, be reinstated within a period of 50 days.
The appellants had challenged the earlier judgement passed by a single judge upholding their dismissal from service.
The High Court also allowed the state government to not assign them any duties for the next 30 days and to conduct departmental inquiries if required.
The officers will also not be eligible for any salaries or dues during the period they remained dismissed.
The APSC’s cash-for-jobs scam came to light in 2016 and during investigations by the Assam police, 70 people, including its former chairman Rakesh Kumar Paul and 57 civil service officials, were arrested.
